Welcome to BabyZenn. These Terms of Service ("Terms") govern your access to and use of the BabyZenn website, application, and services (the "Service") operated by BabyZenn, Inc. ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
By accessing or using BabyZenn, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Your continued use after such notice constitutes acceptance of the revised Terms.

You retain ownership of all content you create, upload, or share through the Service ("User Content"), including registry items, notes, photos, and messages.
By posting User Content, you grant BabyZenn a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service. This license ends when you delete your content or account.
You represent that you own or have the necessary rights to your User Content and that it does not infringe on the rights of any third party.
BabyZenn allows you to add product links from third-party retailers. We do not sell products directly and are not responsible for the availability, quality, pricing, or fulfillment of third-party products. Your purchases from third-party retailers are governed by their terms and policies.
Links to third-party websites are provided for convenience only. We do not endorse or assume liability for third-party content, services, or practices.
The core BabyZenn service is free. Optional paid features ("BabyZenn+") are available via subscription.
The Service — including its design, code, logos, trademarks, and content (excluding User Content) — is owned by BabyZenn, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without prior written consent.
You may terminate your account at any time by going to Settings → Delete Account. We will remove your data in accordance with our Privacy Policy.
We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if we are required to do so by law. Where possible, we will provide notice and an opportunity to export your data before termination.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including Limitation of Liability, Indemnification, and Governing Law) will survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any information, product recommendations, or content provided through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABYZENN, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless BabyZenn, Inc. and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Austin, Texas. You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BabyZenn regarding your use of the Service and supersede all prior agreements, understandings, or communications.
